These terms govern the use of fotografopuntacana.com and the booking of photography services from Babula Shots (Michal Babula) in Punta Cana, Bávaro, Cap Cana and nearby areas. By booking or paying a deposit through this site you confirm that you have read and accept them.
1. Who provides the service
The service is provided by Michal Babula, professional photographer, under the Babula Shots brand (Babula Shots RD). This site covers sessions in the Punta Cana area only; there is no physical office in Punta Cana and the meeting point is agreed for each session. Contact: WhatsApp +1 (809) 778-9547.
2. Services, packages and prices
The available services and packages are those published on this site. Prices are shown in US dollars (USD). Proposal packages state explicitly that ITBIS (Dominican sales tax) is added to the price; for all other packages the price shown is the full price of the service. Services marked "quote" (for example analog film or Saona Island) are quoted in writing before any payment. Anything not listed in the package you booked is not included and may cost extra.
3. Online booking and deposit
When you choose a package, date and time on the "Reservar" page, the time slot is held for 20 minutes while you pay the deposit. If payment is not completed within that time, the hold is released automatically. The deposit is the percentage stated on the package (normally 50% of the full price) and is charged by card through Stripe; we never see or store your card details. Your booking is confirmed only when Stripe notifies us of a successful payment; you then receive a confirmation email with the details. Until then there is no booking.
4. Remaining balance
The remaining amount is paid on the day of the session, before it starts, in cash (USD or Dominican pesos at the agreed rate) or by card through a payment link if you ask for one in advance. If the balance is not paid before the session, the session may not take place and the deposit is not returned.
5. Rescheduling
You may ask to change the date or time up to 72 hours before the session, subject to availability. The first change per booking is free. Further changes, or requests made with less than 72 hours' notice, may carry an administrative fee or may not be possible. Requests are made on WhatsApp or from your booking link and are accepted once we confirm in writing.
6. Cancellations
If you cancel, the deposit is not refunded: it is the consideration for having blocked the date for you. If you cancel with less than 7 days' notice we may additionally charge up to 25% of the remaining balance; if you cancel on the day or do not show up, the full price may be due. If we have to cancel (illness, emergency or force majeure), you receive a full refund of the deposit or a new date at no cost, at your choice.
7. Weather
Rain in Punta Cana is usually brief. If the weather makes outdoor photography impossible or unsafe, we move the session to another time the same day or to another date at no cost; the decision is taken together. Weather does not entitle you to a refund of the deposit while a reasonable alternative date exists.
8. Resorts, beaches and permissions
Many resorts restrict outside photographers or require a day pass. It is your responsibility to confirm with your hotel whether the session is allowed and on what conditions, and to cover the cost of any pass or permit. We do not promise access to any resort or private location. If access is refused, the session takes place on a nearby public beach or alternative location; this does not entitle you to a refund.
9. Drone
Drone flights depend on the weather, applicable regulations and the permissions of the location (many resorts prohibit them). If the drone cannot fly for reasons outside our control, the drone portion of the price is refunded or replaced with ground photography, whichever you prefer.
10. Delivery of photographs
We deliver an edited teaser within the first 24-48 hours after the session and the full edited gallery within the timeframe confirmed in writing at booking, through a private high-resolution online gallery. The number of edited photos is the one stated in your package; we select the best images. RAW files are not delivered unless expressly agreed. Full delivery requires full payment of the service.
11. Copyright and use of the images
Copyright in all images belongs to Michal Babula. On full payment you receive a personal, non-exclusive, non-transferable licence to use the delivered photos for personal purposes: printing, sharing on your social media and keeping them. It does not include selling them or any commercial use without written permission. We may use the images in our portfolio, website and social media; if you or anyone photographed prefers not to appear publicly, tell us in writing before the session and we will honour that at no cost.
12. Your responsibilities
Arrive on time at the meeting point (late arrival is deducted from the session time); tell us in advance about special requests, the number of people and any relevant health or mobility condition; make sure everyone to be photographed is present and informed; and handle the permissions described in section 8.
13. Liability
We work with care and professional equipment, but our total liability to you for any session is limited to the amount you paid for that session. If images were lost due to a technical failure, we refund everything you paid in full. We are not liable for indirect losses or for delays caused by third parties (resorts, transport, weather).

15. Governing law and changes
These terms are governed by the laws of the Dominican Republic, without prejudice to any consumer rights granted to you by the law of your country of residence. We may update them; the current version is the one published on this page with its date. For any question, message us on WhatsApp.
